उपर्युक्त आवेदन का परीक्षण व्यापार चिह्न अधिनियम, 1999 और व्यापार चिह्न नियम, 2017 के प्रावधानों के अधीन किया गया है और जिस व्यापार चिह्न के लिए आवेदन किया गया है उस पर निम्नलिखित धाराओं के अधीन आपत्ति उठाई गई है: :

     The above mentioned application has been examined under the provisions of Trade Mark Act,1999 and Trade Mark Rules, 2017 and the trade mark applied for is open to objection under the following sections :

1.        The objection is raised under S 9(1) (a) of the Trade Marks Act 1999, as the mark is a non-distinctive and as such it is not capable of distinguishing the goods or services of one person from those of others.

कि इस परीक्षण रिपोर्ट की प्राप्ति की तारीख से एक महीने के भीतर सहायक दस्तावेजों के साथ अपनी प्रतिक्रिया/प्रस्तुतिकरण, यदि कोई हो, प्रस्तुत करें या आप सुनवाई के लिए आवेदन कर सकते हैं।

Hence, the above application is liable to be refused. Accordingly,

requested to submit your response/submissions, if any, along-with supporting documents,with in ONE MONTH from the date of receipt of this Examination Report or you may apply for a hearing.

         कृपया ध्यान दें कि यदि उपर्युक्त निर्धारित समय के भीतर कोई उत्तर प्राप्त नहीं होता है या सुनवाई के लिए अनुरोध नहीं किया जाता है, तो उक्त आवेदन को व्यापार चिह्न अधिनियम, 1999 की धारा 132 के तहत अभियोजन के अभाव में परित्यक्त माना जाएगा। इसके बाद कंप्यूटर डेटाबेस में आवेदन की स्थिति वास्तविक स्थिति को दर्शाएगी।

         Please Note that if no reply is received or a request for a hearing is applied for within the above mentioned stipulated time ,the said application shall be treated to have been abandoned for lack of prosecution under Section 132 of the Trade Marks Act,1999 and there after the status of application in the computer database shall reflect the factual position

         Note:Note: The reply should be submitted online via Comprehensive eFiling Services through Miscellaneous Reply > Reply to Examination Report (MIS-R) with the subject as ‘REPLY TO EXAMINATION REPORT’. If, reply requires filing of TM-M --> Correction of Clerical Error for Amendments U/r 37 then, subsequently Reply to Examination Report (MIS-R) is also to be filed.
