व्यापार चिह्न अधिनियम 1999 की धारा 21(2)के अनुसरण में मुझे पंजीकार, व्यापार चिह्न द्वारा उपर्युक्त आवेदन के विरोध की सूचना की प्रतिलिपि संलग्न करने का निदेश हुआ है।

इस संबंध में आपका ध्यान व्यापार चिह्न अधिनियम 1999 की धारा 21(2) तथा व्यापार चिह्न नियम 2017 के नियम 44 की ओर आकर्षित करते हुए यह इंगित किया जाता है कि आप तीन प्रतियों में फार्म टी एम-ऒ(काउंटर स्टेटमेंट) पर विरोध की सूचना की प्रति इस पत्र प्राप्ति की तारीख से दो महिने के भीतर आप/आवेदक उन कारणों का प्रतिकथन जिन पर की आप अपने आवेदन के लिए भरोसा करते है और यदि आप ऎसा नही करते है तो यह समझा जायेगा कि विरोध की सूचना में बताये गये मुद्दे आपको/आवेदक को मान्य है।

आपको यह भी सूचित करने का निदेश दिया गया है कि यदि कोई प्रतिकथन इस कार्यालय में उपर्युक्त समय सीमा के भीतर प्राप्त नही होता है तो अधिनियम की धारा 21(2) के तहत आपका आवेदन परित्यक्त कर दिया जायेगा।

In pursuance of section 21(2) of Trade Marks Act 1999,I am directed by the Registrar of Trade Marks to enclose herewith a copy of the Notice of Opposition filed to the application noted as above.

In this connection I am to invite your attention to Section 21(2)of the Act and also to Rule 44 of the Trade Marks Rules, 2017 and to point out that a counterstatement of the grounds, on which you /their application should be filed at this office in triplicate on Form TM-O(COUNTER STATEMENT) within two months from the receipt by you of the copy of the notice of opposition.The counterstatement should also set out what facts if any, alleged in the notice of opposition are admitted by you/their applicants.

I am further directed to inform you that if such a counterstatement is not received in this Registry within the aforesaid time the applicants will be deemed to have abandoned his/their application(vide section 21(2) of the Trade Marks Act.1999)
